01
Who we are
The Nana app, the website at https://nana.coach and the related services (together, the “Service”) are provided by:
- Nana Amparo BV
- Skiweg 3, 9000 Gent, Belgium
- Enterprise number (KBO/BCE): BE1037941966
- Email: support@nana.coach
- Phone: +32 486 29 51 01
In these terms, “Nana”, “we”, “us” and “our” mean Nana Amparo BV. “You” means the person who creates an account or uses the Service.
02
What the Service is
Nana is a mobile app that offers fueling and performance advice for female athletes. The features included are described in the app and on our website, and form part of your contract.
03
Who can use the Service
You must be at least 17 years old. If you are younger, you may only use the Service with the consent of a parent or legal guardian, who is then responsible for your use.
04
Your account
4.1 You must give accurate information when you register and keep it up to date.
4.2 Keep your login details confidential. You are responsible for activity on your account unless someone else used it without your fault. Tell us as soon as you suspect unauthorised use.
4.3 You can delete your account at any time in the app or by contacting us (see Section 13).
05
When the contract starts
By ticking the acceptance box when you sign up, you agree to these terms. For paid plans, the contract starts when we confirm your order by email or in the app.
We will keep the version of the terms you accepted, and you can always find the current version at https://nana.coach/terms-and-conditions. On request, we will send you a copy.
06
Wellbeing notice
The Service offers general nutrition and performance guidance. It is not medical, psychological or therapeutic advice and does not replace a doctor or other qualified professional. If you have a health concern, talk to a professional. In an emergency, contact your local emergency number. Results depend on you and vary from person to person, and we cannot promise specific outcomes.
07
Prices, subscriptions and payment
7.1 Prices. All prices shown are in euros and include VAT and any other mandatory charges. Any additional costs are shown before you confirm your order.
7.2 Subscriptions. Paid plans are billed monthly or yearly in advance. Unless you cancel, your subscription renews automatically for the same period at the price then shown to you. The price, billing period, renewal terms and how to cancel are shown before you order.
7.3 Payment. You can pay with the methods offered at checkout. Payments are processed by the app stores, and we do not store your full card details. If a payment fails, we will let you know and give you a reasonable period to fix it before we suspend your paid access.
7.4 Price changes. We will only change the price of an ongoing subscription by notifying you at least 30 days beforehand. The change applies from your next renewal, and you may cancel before then without cost. Price changes never affect a period you have already paid for.
7.5 Errors. If we made an obvious pricing error, we will tell you before taking payment and you can decide whether to proceed at the correct price. If you have already paid, we will refund you in full.
08
Cancelling your subscription and refunds
8.1 You can cancel your subscription at any time in your account settings. Cancelling stops the next renewal. You keep access until the end of the period you already paid for.
8.2 Payments for a period already started are generally not refunded, unless the law requires it or we cannot provide the Service you paid for. If you are not satisfied, contact us, and we will look for a fair solution.
8.3 If you subscribed through an app store (such as Apple or Google), cancellation and refunds are handled by that store under its rules, in addition to your legal rights.
09
Your legal rights if something is wrong
We must provide the Service in line with what we promised. If the Service (or digital content) does not conform to the contract, you have the legal rights that apply to consumers, such as having it brought into conformity, a price reduction or ending the contract, depending on the situation. These rights cannot be limited by these terms. Contact us, and we will try to fix the problem quickly and free of charge.
10
Acceptable use
You agree not to:
- Break the law or infringe the rights of others when using the Service;
- Share your account, or resell, rent, or make the Service available to others commercially;
- Copy, modify, decompile or reverse engineer the Service, except where the law expressly allows it;
- Remove copyright or other proprietary notices;
- Upload malware or try to disrupt, overload or gain unauthorised access to our systems or other users’ accounts;
- Use automated tools (bots, scrapers) to access the Service without our written permission;
- Post unlawful, harassing, hateful, or misleading content.
11
Your content
11.1 You own it. You keep all rights to the content you put in the Service (such as texts, notes, entries and files) (“Your Content”).
11.2 Licence to us. You give us a non-exclusive, worldwide, royalty-free licence to store, process and display Your Content only as needed to provide, secure and improve the Service for you. This licence ends when you delete the content or your account, except where we must keep it by law or for backups for a limited time.
11.3 Personal data. How we handle personal data in Your Content is explained in our Privacy Policy.
12
Feedback and our intellectual property
12.1 The Service, its software, design, text, graphics, trademarks and other content are owned by Nana or our licensors and are protected by intellectual property laws. You receive a personal, non-exclusive, non-transferable, revocable right to use the app for your own non-commercial purposes in line with these terms. No other rights are granted.
12.2 If you send us ideas or suggestions about the Service, you grant us a free, non-exclusive, perpetual licence to use them without any obligation to you. You keep any rights you have that cannot be transferred or waived under law, and this does not apply to Your Content or personal data.
13
Contact and complaints
13.1 Contact us at support@nana.coach or +32 486 29 51 01. We aim to reply within 5 working days.
14
Changes to the Service and to these terms
14.1 Changes to the Service. We may update or improve the Service, including for security or legal reasons. If we make a change that affects your use of the Service more than a little, we will tell you in good time.
14.2 Changes to these terms. We may change these terms for valid reasons, such as changes in the law, new features or security needs. We will notify you at least 30 days before a change takes effect (by email or in the app). If you do not agree, you can cancel before the change takes effect. If you keep using the Service after that date, the new terms apply. Changes never apply to a period you already paid for.
15
Privacy
We process personal data in line with the GDPR and Belgian law, as described in our Privacy Policy at https://nana.coach/privacy-policy/.
16
Availability, third parties and app stores
16.1 We work to keep the Service available, but we cannot promise that it will be uninterrupted or error-free. We may carry out maintenance and will try to limit disruption.
16.2 The Service may link to or work with third-party websites and services. We do not control them, and their own terms and privacy policies apply. We are not responsible for them, except where the law says otherwise.
16.3 If you got the app from an app store, the store’s terms also apply. Those terms do not limit your rights under these terms or the law.
17
Our liability
17.1 We are liable for damage caused by our fault, as provided by law.
17.2 Nothing in these terms excludes or limits our liability for death or personal injury, for intent or fraud, for gross negligence, or for anything else that cannot be excluded or limited under mandatory law.
17.3 We are not liable for damage that was not reasonably foreseeable when the contract was concluded, for damage caused by your device or internet connection, or for events outside our reasonable control (force majeure).
17.4 Section 6 also applies to the advice and information the Service gives.
18
Suspension and termination
18.1 By you. You may end your contract at any time.
18.2 By us. We may suspend or close your account if you seriously or repeatedly break these terms, or if you don’t pay. Where reasonable, we will warn you first and give you time to fix the problem. We may also end your contract for any other valid reason with at least 30 days’ notice.
18.3 Your data. After your account ends, you can ask us to export Your Content for 30 days (where technically possible). After that, we delete it, except where we must keep it by law. The Privacy Policy explains how long we keep data.
18.4 Sections that by their nature should survive termination continue to apply.
19
Governing law and disputes
19.1 These terms are governed by Belgian law. If you are a consumer living in another country, you also keep the protection of the mandatory consumer laws of that country.
19.2 If you are a consumer, you can bring a dispute before the courts of Belgium or the courts of the country where you live. We can only bring a claim against you in the courts of the country where you live. There is no mandatory arbitration, and you do not waive the right to go to court.
20
General
20.1 Entire agreement. These terms, together with the Privacy Policy, and the information given at checkout, form the entire agreement between you and us about the Service.
20.2 Invalid parts. If a part of these terms is not valid or enforceable, the rest stays in force, and the invalid part is replaced by a valid one that comes closest to its intent.
20.3 No waiver. If we do not enforce a right straight away, we do not give it up.
20.4 Transfer. We may transfer our rights and obligations to another company if this does not reduce your rights. You may not transfer your account or contract to someone else without our consent.
20.5 Language. These terms are available in English.
